POCSO rape accuse convicts for RI by Spl Judge Shimla

 The Special Judge  Shimla, Amit Mandyal convicted the minor rape case accused  Geeta Ram sentencing him for Rigorous Improvement for 25 yrs, today.

The convict was booked under section 376 (AB) 452 IPC & section 4 of the POCSO Act in a case titled as State of H.P. Versus Geeta Ram( FIR No. 36/2021) on March 31  2021 at Police Station Chopal. 

The accused has been sentenced to undergo rigorous imprisonment for a period of 25 years along with a fine of Rs.25, 000 U/S 6 of the POCSO Act and simple imprisonment of 2 years along with a fine of Rs. 1,000 U/S 452 of IPCThe Ld. Trial Court POSCO has also recommended 3,00,000 in compensation to the victim.


Brief facts of the case:-

On 30.03.2021, the victim aged about 4 years was alone at her home as the mother of the victim had gone to her relative house at that time accused who was in the neighborhood of the victim’s family came to their house and committed aggrieved penetrative sexual assault with the victim. 

When the mother came to the house than victim disclosed the entire incident to her mother. On the basis of these facts, FIR was registered Under Section 376 (AB) 452 IPC & Section 6 of the POCSO Act at Police Station Chopal, After completion of the investigation challan was put up before the Ld. Trial Court.

During the Trial, the Prosecution examined 13 witnesses to prove their case and at the conclusion of the trial the arguments were heard, and Ld. Special Judge, Shimla convicted the accused for the commission of the offence as alleged above. 

The State of Himachal Pradesh was represented by Mrs. Sangeeta Justa, Special Public Prosecutor Shimla.
