High Court takes suo-moto cognizance of damage caused by uncontrolled & unscientific blasting
Himachal Pradesh High Court has taken suo moto cognizance of damage caused by un-controlled and unscientific blasting by Luhri Hydroelectric Project, Phase-1, Rampur, District Shimla.
A Division Bench, comprising Chief Justice M.S. Ramachandra Rao and Justice Ajay Mohan Goel, passed this order on a petition taken up suo moto as Public Interest Litigation by the High Court.
Bench in a suo moto cognizance impleaded the state of Himachal Pradesh through its Chief Secretary as a party as the Court has directed the Secretary, District Legal Services Authority Kinnaur at Rampur Bushahr, to submit a report on the dumping of muck.
The Secy DLS also submit a report also of damage caused to the rock which is said to be above village Narola, Panchyat Neerath, Tehsil Rampur Bushahr, District Shimla, H.P., which might cause a threat to the life and property of the people of the said village.
The Court has further ordered that Assistance of the Geology Department of IIT Rurki may also be taken on the latter aspect and the Registrar of the IIT Rurki has been directed to spare teaching faculty of the subject Geology for inspecting the site in question in the matter.
The Government of Himachal Pradesh has been directed to make available a sum of Rs. 1.00 lac towards tentative cost by it to the Registrar, l|T Rurki, for making the inspection, as aforesaid.
The report of the Secretary, District Legal Sevices Authority Kinnaur at Rampur Bushahr, has been ordered to be filed by 31.07.2023 and the matter has been ordered to be listed on 03.08.2023.
