Defying court order High Court issues contempt notices to HP Secretary home
Himachal Pradesh High Court today issued notices to Principal Secretary Home, Deputy District Attorney Excise and Taxation. Kishan Singh Verma and Aditional District Attorney Ms. Shweta Sadyal for defying court order.
The order was passed by the Division bench of Acting Chief Justice Tarlok Singh Chauhan and Justice Virender Singh today stated that in the Prashant Singh vs. State of H.P., case bench had passed today that DDA and ADA did not join their duty defying its earlier order.
Court said State canceled the transfer order of Kishan Singh Verma, DDA, and Shweta Sadyal, ADA in utter defiance of the orders passed by this Court. Therefore, a notice of contempt was issued to the Principal Secretary (Home) to the Government of Himachal Pradesh; and Sh. Kishan Singh Verma, DDA, office of Commissioner, State Taxes & Excise, Shimla, and Ms. Shweta Sadyal, ADA, office of HPPCL, Shimla, to be served upon them through the Director Prosecution.
Till then, both Kishan Singh Verma, DDA, and Shweta Sadyal, ADA are restrained from joining at their respective place of posting(s), and in case, they have joined, they are restrained from performing any duties.
The bench observed that Courts have come to a grinding halt only because for want of the Deputy District Attorneys and ADAs not joining or for want of appointment, even despite the orders passed by this Court in CWP No. 1930 of 2020.
The court fixed the next hearing in the case on May 9, 2023, for a complaint of a court order.
