Three Identical Defamation Suits Filed Against Himachal Pradesh Chief Minister
In a politically charged environment amidst the Lok Sabha and bye-elections, Himachal Pradesh Chief Minister Sukhvinder Singh Sukhu faces multiple defamation suits. Three identical cases have been filed against him by BJP candidates and Independent MLAs, all alleging that his statements have tarnished their reputations.
A significant suit was lodged on Friday in the Himachal Pradesh High Court by BJP candidate Devinder Kumar, also known as Devinder Bhuto, and Independent MLA Hoshiyar Singh. They claim that the Chief Minister referred to them as “sold MLAs” during a political meeting, which they argue has damaged their public image. The plaintiffs are seeking damages of Rs 1.05 crore.
The matter was heard by a bench comprising Judge Jyotsna Rewal Dua. Devinder Bhuto, who is also contesting a bye-election following his disqualification by the Speaker, asserts that these statements have adversely affected his political career. Represented by Advocate Anshul Attri, the plaintiffs requested a permanent prohibitory injunction against the Chief Minister to prevent further dissemination of the alleged defamatory remarks.
The application, filed under Order 39 Rules 1 & 2 read with Section 151 of the Code of Civil Procedure, seeks to restrain Sukhu from making or repeating such statements on any public or social media platform. Despite the seriousness of the allegations, the court did not issue any immediate injunction. The matter is scheduled for a hearing after the Lok Sabha elections.
The court, upon reviewing the allegations, issued a notice to Chief Minister Sukhu, returnable by June 18, 2024, with instructions to take necessary steps within three days. This legal battle comes at a sensitive time for Devinder Bhuto, who is navigating a bye-election campaign amidst these allegations.
In addition to this case, BJP candidate from Dharamshala, Sudhir Sharma, has also filed a similar defamation suit against the Chief Minister. Initially before Justice Satyan Vaidya, this matter is now listed for hearing in July. Furthermore, another suit has been filed by BJP candidate Inderdut Lakhanpal (Badsar) and Independent MLA K. L. Thakur (Nalagarh). This third case is set to be heard by Judge Jyotsna Rewal Dua on May 26.
These multiple legal actions underscore the tense political climate in Himachal Pradesh during this election period. The outcomes of these defamation suits could significantly impact the political careers of the involved parties and shape the broader political dynamics in the state.
The Chief Minister’s office has yet to respond publicly to these notices. As the cases progress, they will be closely watched for their potential impact on the reputations and electoral prospects of the involved politicians.
