POCSO accused sentence for 20 yrs RI

Additional District and Sessions Judge – POCSO Court, Solan, Dr.  Parvinder Singh Arora convicted and sentenced a POCSO accused for committing forcibly sexual act with a minor on Tuesday. A press release issued by the district police Solan on Wednesday said that accuseds youth Lakhan S / O Sh. Shiv Lal , R / O Village and Post Office Bandi , Teh- Mahawan Distt Mathura  found guilty for the above Crime sentenced to rigorous imprisonment for 20 years under Section 4 of POCSO Act and read with section 376 ( 2 ) ( i ) of IPC and fine of Rs.25.000. In default of payment of time he shall further undergo simple imprisonment for one year. According to prosecution , in the year 2017 , the child victim went on the roof of her house to answer the call of nature them .  She was lifted by the accused , who was residing in the adjoining building and taken to his room.  The accused committed the sexual assault in a gruesome manner upon the victim in order to satisfy his lust resulting into injuries upon the body of the victim .. On the complaint of her father , case under Section 376 IPC and Section of POCSO Act against the accused  was registered in Police Station , Nalagarh .  The case was investigated and the statement of victim child was also recorded by the Judicial.  Magistrate, during investigation.  The case on behalf of the prosecution was conducted by Sh.  Sunil Dutt Vasudeva, Special Public Prosecutor.  The Ld.  Court has observed that minor girl child victim has to suffer mental trauma and physical pain on account of over act by the accused .  The said act would have lasting effect on her personality.  The accused 28 years of age forced himself upon a six and half years old defenseless girl, when she was lonely.  The accused in order to satisfy his lust committed offence.  Keeping in view the facts and the circumstances the court also recommends the payment of compensation to child victim in the sum of Rs.  9 lac on account of relief and her rehabilitation.  The 80 pc amount of the compensation amount shall be deposited in shape of FDR in the name of victim and the 20 p c amount may be disbursed in favor of the victim forthwith for her rehabilitation .
