Kundu to remain DGP, Supreme Court stays HC order

The Supreme Court has ordered that the posting of Kundu on the post of Principal Secretary of AYUSH will not be effective for now.  The Supreme Court has also asked the High Court to decide within two weeks on Kundu’s application to withdraw the order.

The three-judge bench of SC comprising Chief Justice of India D Y Chandarchud, Justice Manoj Mishra, and Justice J B Pardiwal after hearing the counsel for DGP Mukal Rohtgi and complaint counsel Rahul Sharma during an hour proceedings directed Himachal Pradesh High Court through Registrar General that it would provide opportunity to the petitioner DGP to hear his recall application against the impugned order passed by Himachal Pradesh High court on December 26, 2023.

“Till a decision on the petitioner’s recall application, the high court order on transfer shall remain stayed. Since the petitioner’s new posting is pursuant to the impugned order of the high court, no steps shall be taken,” stated the bench.

The order was issued on a petition moved by Kundu earlier this week, complaining that the unpropitious directive against him was issued by the high court on December 26 without allowing him to present his side.

After the decision of the High Court, the government on Tuesday removed Kundu from the post of DGP and appointed him Principal Secretary AYUSH.  Besides, ADGP CID Satwant Atwal has also been given an additional charge of DGP.  Now what the government will do remains to be seen.
