Himachal Pradesh High Court adjourns hearing on Wildflower hall till Jan 5

Himachal Pradesh High Court adjourned the hearing on the issue of taking over possession of the five-star Wildflowers Hall Hotel from East India Hotel Ltd till January 5 on Friday.

Single judge bench of Justice Satyan Vaidya adjourned the hearing on the matter till January 5 as the state has filed an execution petition before the High Court to take back the possession of Rs 500 Cr Wildflowers hall and around 120 big lands attached with the property.

The order passed by the court said that the next hearing in the matter is fixed for January 5, 2024.

On Friday the counsel for the state Mr. Dhruv Mehta, Sr. Advocate with Mr. Prabhat Kumar (through Video conference), Mr. I.N. Mehta, Senior Additional Advocate General with Mr. Vivek Negi and Advocate, for respondents Mr. R.L. Sood, Sr. Advocate with Mr. Arjun Lal, Ms. Sanjeevni Sood and Mr. Aakash Thakur, Advocates were present.

On November 17, the State Government issued notice to EIH to vacate the property but on November 18, 2023, EIH got the stay on the proceedings of the November 17 order which was continued. 

The State Government has submitted before the HC that it wants the possession of the property after an arbitration award was passed in favor of the state government in 2022 after twenty years of legal battle on the issue.

Earlier to this EIH Ltd submitted a draft of an arbitration award in the court and urged the court that the state should order to continue the possession of property with it and extend the arrangement further.
