Himachal High Court has ordered to withhold salary of Principal Secretary and Director of Education Department for not complying with the court order in service matter of a petioner. The division bench of Justice Sabina and Justice Sushil Kukreja directed to comply with the previous orders passed by the High Court as hearing was held in this matter on Tuesday. The bench found that during during the hearing of the case on December 9, the bench has directed to release the pending due of a lecturer with in 48 hrs of passing the order but Higher Education Department failed to pay the service related financial benefits to the applicants. The respondents ignoring the court direction directed today to withhold the salaries of Secretary and Director Education. The petioner was serving as private lecturer at Maharaja Sansar Chand Memorial Degree College, Kangra. On October 18, 2006, his services were attached over by the state government after taking over the college. The petioner said that respondents state after taking over the college, fixed his salary lower than they were already being paid by the private colleges. As the petitioner moved to High Court an orders has issued to department to provide them higher pay scale as per the decision given by the High Court in the case of Premlata Thapar. But the State Government failed to give the scales of pay to the applicants due to the pendency of the appeal in the said case. Since the day of decision on June 30, 2022 on govt appeal the dues were not released to petioner. Court found the case of disobedience of orders to withhold the salaries of both the officers on December 9. But both the officers failed to give the financial benefits linked to the pay scales of the applicants before the date fixed for Tuesday. The court prohibited the withdrawal of salaries of both the officers without the permission of the court. A hearing on the matter has been fixed for January 12, 2023.
