High Court extends Anticipatory bail to Independent MLA till April 1

Himachal Pradesh High Court has extended the interim anticipatory bail period granted to Gagret MLA Chaitanya Sharma’s father Rakesh Sharma and Hamirpur independent MLA Ashish Sharma till April 1.

The single judge bench of Justice of Ranjan Sharma ordered both applicants to register their presence when they were issued presence warrants by Boileauganj police and cooperate in the investigation. 

However, the court has also given both the applicants the exemption to ensure their presence only as per their health-related problems.

 The court was informed by the applicants that the applicants were unable to appear before the Boileauganj due to health reasons.

According to the facts given in the petitions, a case has been registered against Congress rebel and Gagret disqualified MLA Chaitanya Sharma’s father and Hamirpur independent MLA Ashish Sharma at Shimla’s Baluganj police station.

 A case has been registered against both of them under sections 420, 171 A and 171 C, 120 B of the Indian Penal Code and sections 7 and 8 of the Prevention of Corruption Act.  

In the FIR, the rebel MLA’s father and the independent MLA have been accused of influencing the Rajya Sabha elections unfairly. 

The complainants have accused both of them of buying and selling of votes, bribery and money transactions. The complaint states that the accused conspired to topple the government. 

The complainants have also demanded an investigation into the bank accounts of Hamirpur’s independent MLA Ashish Sharma and the father of disqualified MLA Chetan Sharma. The next hearing on both the petitions will be held on April 1.
