HC stays order of HPPEIRC against MMU & Medical College Kumarhati
HP Private Educational Institutions Regulatory Commission’s stayed the June 9, 2022 order against Maharishi Markandeshwar University & Medical College Kumarhati, Solan district of Himachal Pradesh on Friday as the Commission ordered to refund Rs 103.96 Cr. excess fee charged from about 1100 MBBS students between 2012 and 2020. The order passed by the Division bench of chief Justice A.A. Sayed and justice Jyotsna Rewal Dua
on the Civil Writ Petition filed before the High court on July 19 by MMU and otherd challenging order of HPPEIRC Shimla. The counsel for MMU Mr. K.D. Shreedhar, Counsel for HPPEIRC Mr. Naresh Kaul was present in the court. Advocate General for State Ashok Sharma also appear
accept service of notice on behalf of respondent No. 1 and
respondent No. 4, respectively and seek time to file reply. The court also issued notice to complaints( respondent no 5 &6) . The bench said that In as much as the jurisdiction of the Commission in respect of levy of excess fee and penalty is questioned, court direct
that till the next date, the impugned order dated 9.6.2022 should stand stayed.
On June 9 taking cognizance of two separate Complaints, HPPEIRC found the respondent University and others guilty for charging excess amount of Rs. 6.05.500/- from Dr. Nividita and Rs. 8,95,500 / – from Dr. Yamini which amounts to Rs. 15,01,000. Commission said in the order that records of University submit before it also revealed that more than 1100 students who passed out and studing between 2012 to 2020 were charged excess fee tunes to Rs.1,03,965,300. On July 22 this matter was listed for hearring before the Division bench of justice Tarlok Singh Chauhan and justice Chander Bhushan Bariwala but bench recused from issue stating that Chairman of Commission is known to them. Now the matter is listed before the four week of passing this order.
