HC reserves order in death sentence to kidnap & rape convict
Himachal Pradesh High Court has reserved its decision in the case of kidnapping, rape and murder of a girl child in the famous Baddi of the state. The High Court would hear in the coming days the confirmation of the death sentence awarded to accused Akash, a resident of Uttar Pradesh. Division bench of Justice Sabina and Judge Sushil Kukreja’s reserved its decision after hearing the arguments of defence and persecution in the death sentence awarded by the Fast Track Court Solan. The convict had challenged the conviction and death sentence before the High Court. Accused was found guilty in the fast track trial and police investigation who first raped a 7-year-old innocent girl 2017 and later strangled to death at Baddi, the biggest industrial area of the state. In the investigation of the case, it was found that crossing the limits of brutality, a piece of wood was also inserted in the private part of the girl. On February 2022 fast track court of Additional district and sessions judge Parvinder Singh Arora awarded the death sentence to Akash Kumar a resident of Hardoi district of UP . This is the first case under the Protection of Children from Sexual Offenses (POCSO) Act in Himachal Pradesh where a sessions court has sentenced a convict to death. District sessions judge Solan had been declared this heinous and case of rarest of rare nature as court found the convict guilty under Section 302, 376 of IPC and Section-10 of the POCSO Act.
