Governor Shukla releases book authored by Dr. Bharat Barowalia

Governor Shiv Pratap Shukla released a book authored by Dr. Bharat Barowalia titled ‘Balancing The Scales: Proportionality of Sentencing for Narcotic Drugs and Psychotropic Substances Offences’ at Raj Bhavan Shimla, today.

The book focuses on the sentencing of the criminals by the Courts in cases of Narcotic Drugs and Psychotropic Substances. Cases of the Supreme Court and the High Courts of Himachal Pradesh and Punjab and Haryana have been analysed in the context of what factors change in the quantum of imprisonment or sentence afforded to the convict and accused.

On the occasion, the Governor said that with its rigorous scholarship, thought-provoking insights, and impassioned advocacy for justice, this book promises to be an indispensable resource for legal practitioners, policymakers, scholars and anyone interested in understanding the intricate dynamics of drug sentencing laws. Shri Shukla said that one of the key highlights of the book is its examination of the historical context and legislative intent behind the NDPS Act, shedding light on the societal factors that influenced its enactment and subsequent amendments. By tracing the evolution of drug sentencing laws, Dr. Bharat Barowalia has offered invaluable insights into the underlying principles and policy objectives driving the enforcement of drug laws in India, he added.

While appreciating the efforts of the author, the Governor said that this book would prove beneficial not only for legal scholars but also for researchers. He expressed contentment that through meticulous research and insightful analysis, Dr. Barowalia has provided a comprehensive overview of the legal framework governing drug-related offenses and the sentencing guidelines prescribed under the NDPS Act.

Dr. Bharat Barowalia is currently Assistant Professor (Law) at Himachal Pradesh National Law University, Shimla and is a regular resource person at Himachal Pradesh Judicial Academy, Shimla. Commenting on the release of the book, Dr. Bharat Barowalia stated, “My aim in writing this book was to provide a comprehensive resource that not only elucidates the legal intricacies of drug sentencing but also fosters a deeper understanding of the broader societal implications of our drug abuse control policies. It is my hope that this book will serve as a catalyst for informed discourse and meaningful reforms in our approach to drug-related offenses.”
