Go ahead with new OPD : High Court to IGMC
Himachal Pradesh High court today directed the Indira Gandhi Medical College hospital Administration to go ahead for using and opening newly built OPD block in the hospital despite not having National Green Tribunal nod for the project in an order passed on Friday.
Division bench of Justice Tarlok Chauhan and Justice Satyen Vaidya, allowed state to use new OPD block of the IGMC Shimla for the purpose of COVID-19 services.
The order issued by HC mention “In view of the new variant of OMICRON variant of COVID-19, that is spreading widely in the entire Country, we deem it proper to permit the petitioner-State to open New OPD Block or Trauma Ward at IGMC, Shimla, on purely humanitarian consideration, solely for the purpose of patients of COVID-19.”
The DB after hearing the matter, allowed the State government to use the aforesaid premises (New OPD Block and Trauma Block) for providing COVID-19 services.
The court further said that however, this order is being passed taking into consideration the exigencies of the prevalent conditions and shall not be construed to be conferring any kind of right upon the petitioner-State.
The order further said that any other person or authority and this order should otherwise also not be treated or cited as a precedent, till and so long, the issue of jurisdiction is not decided,.
The court has further listed the matter for hearing on Feb 22, this year.
Affected by a NGT order to not allowed any deviation in the construction in the core area of Shimla, State government has approached the High court.
State has challenged the order passed by the NGT and its appointed Supervisory committee that project couldn’t be given final clearance waiving off the deviation in this project.
