BJP candidate from Chamba get relief from conviction before filling nomination
Himachal Pradesh High court today stayed the conviction of BJP candidate from Chamba Assembly Constituency Ms. Indira Kapoor who is a convicted of Special judge Chamba in corruption case. The single bench of justice Sandeep Sharma allowed the appeal of Indira Kapoor against Impugned judgement and granted stay on the conviction on Thursday. In judgment of conviction and order she was sentence on 7.8.2021 in order passed by learned Special Judge, Chamba Division Chamba (HP) in Corruption Case of 2015. The spl judge holding the applicant or appellant guilty for having committed offence punishable was convicted and sentenced under 420 IPC (Simple imprisonment for three years Rs.10,000 Imprisonment for one month) 467 IPC( Simple imprisonment for three years Rs.10,000 Imprisonment for one month) 468 IPC( Simple imprisonment for three years Rs.10,000 Imprisonment for one month ) 471 IPC (Simple imprisonment for three years Rs.10,000/- Imprisonment for one month) 13(2) of Prevention of Corruption Act( Simple imprisonment for one year Rs.5,000 Imprisonment for one month). The applicant alleged that, court passed order was passed without scanning the entire evidence holding applicant guilty of offence punishable and there is no sufficient evidence to convict the accused with the alleged offences . The court allowed the application filed against impinge Judgment of conviction and stayed, till the final adjudication of the appeal. The applicant Indira Kapoor along with other accused Roshan Lal, Chikni and Radha Devi were booked and tried for commission of offence punishable under S. 420, 467,468, 471 and 120-B IPC and S. 13(2) of the Prevention of Corruption Act . The BJP leader was Zila Parishad members from Sach ward along with Mohan Singh, a BDC Member of Panchayat Samiti Mehla who was Zila Parishad Member of Ward and Roshan Lal, Gram Panchayat Bharian Kothi, Tehsil and District Chamba are accused and convict of misappropriation .BJP candidate was about to file nomination tomorrow as she was allotted ticket by party.
