After electoral debacle, BJP knocking door of court
Opposition BJP after a month of electoral debacle decided to fight legal battle against new Congress Government as it have filled two petition challenging decision of latter to de notified number of Institutions opened by the former. BJP MP and party state president Suresh Kashyap and former BJP Minister Vikram Singh has filled two separate petition seeking cancellation of notifications to de notified about 940 Institutions opened by previous BJP government after April 1, 2022 without making provision of budget and manpower. The matter was fixed for hearing before the principal division bench of chief Justice A A Sayed and justice Jyotsena Rewal on Wednesday. The Ashok Sharma the senior counsel for petitioner Kashyap and Singh contended before the court that it want to amend the petition to add more notifications of de notified Institutions. The court order the state to submit reply in the matter within four weeks and allowed the petitioner to amend petitions to bring more facts about the matter before the court on the next date after the four week. During previous hearing the high court clubbed the petition filled by Vikram Singh and Suresh Kashyap. The petitioner have challenged the orders or Denotification of about 940 Institutions that decision taken by the council of ministers in the interest of general public couldn’t be cancel by the executive without cabinet approval. Since it was a day after taking of oath as Chief minister Sukhvinder Singh Sukhu and deputy CM Mukesh Agnihotri that number of Institutions opened by former BJP government was de notified illegally. The party demanded restoration of Institutions stating that government work in continuation and decisions taken by previous government could not be strike down. Some of the Civil Division and Institutions are opened by previous BJP government prior approval of High court however new government didn’t followed procedural code to undo decision. It is worthwhile to mention that Electricity board is autonomous body and new Institutions opened by the board with approval of Services committee including Chief Secretary and Secretary finance also could not be denotified by the state government. State government defending its move have accused former chief minister Jai Ram Thakur for opening number of Institutions without making budgetary provision for the same and staff members snd posts are not deployed. The government mainintaing that state have need Rs 5000 Cr to run such Institutions which was opened for sake of poltical benift by former BJP akso rejected by the people. BJP before lodging prorest on the street and state assembly deviced to knock the door of high court to quashed the decision of Sukhvinder Singh Sukhu government terming it Poltical vendata.
